CAR RENTAL AGREEMENT
This Car Rental Agreement has been prepared between Best Motor Marmaris Car Rental and VIP Transfer Services, the vehicle rental service provider, and the Renter/Customer, who benefits from the rental service, under the terms and conditions stated below.
This agreement has been prepared to determine the delivery, use and return of the rented vehicle, payment terms, damage, accidents, traffic fines, customer responsibilities and the rights and obligations of the parties.

2. Subject of the Agreement
The subject of this agreement is the rental of a vehicle owned by the Rental Provider or under the Rental Provider’s right of use to the Renter for the specified period and under the specified conditions.
The Renter agrees to use the vehicle in accordance with the terms stated in this agreement and to return it on the specified date in the same condition as received.

The Renter declares that they have inspected the vehicle before receiving it, seen its current condition and accepted the vehicle as stated in the delivery record.

The rental period is valid between the dates and times stated above. The Renter is responsible for returning the vehicle on the specified return date and time.
In case of late return, an additional fee may be charged by the Rental Provider.

The vehicle shall be delivered at the location determined by the parties and returned at the agreed location. If a different delivery or return location is requested, an additional fee may apply.

The Renter agrees to pay the rental fee in the manner specified in this agreement.
The deposit or security amount shall be refunded to the Renter if the vehicle is returned undamaged, complete, on time and in accordance with the agreement terms. In case of damage, missing fuel, traffic fines, late return, lost equipment or use contrary to the agreement, the relevant costs may be deducted from the deposit.
7. Documents Required from the Renter
The Renter is required to provide the following documents during the rental process:

The Renter accepts that all information provided is accurate, up to date and belongs to them.
8. Driving Licence and User Conditions
The Renter declares that they have a legally valid driving licence to use the rented vehicle.
The vehicle may only be used by the Renter named in this agreement. The vehicle may not be used by third parties without the written or clear approval of the Rental Provider.
If the vehicle is used by an unauthorised person, all legal, criminal and financial responsibility arising from such use belongs to the Renter.
9. Vehicle Usage Rules
The Renter agrees to use the vehicle in accordance with the following rules:

To comply with traffic rules,

To use the vehicle carefully, responsibly and for its intended purpose,

Not to use the vehicle under the influence of alcohol, drugs or any substance that may reduce attention,
-
Not to use the vehicle for racing, speed trials, shows, towing, transport, commercial activities or illegal purposes,
-
Not to carry passengers or loads exceeding the vehicle capacity,
-
Not to use the vehicle on damaged roads, off-road areas, beaches, forest areas or unsuitable surfaces,
-
Not to take the vehicle outside the city or outside the permitted usage area without the approval of the Rental Provider,
-
Not to make any modifications, removals, installations, repairs or technical interventions on the vehicle,
-
Not to leave the vehicle with the key inside or while it is running,
-
Not to leave the vehicle in unsafe areas.
All costs, damages, penalties and legal responsibilities arising from use contrary to these rules belong to the Renter.
10. Fuel Conditions
The vehicle is delivered to the Renter with the fuel level specified at the time of delivery.
The Renter is responsible for returning the vehicle with the same fuel level as received. If the vehicle is returned with missing fuel, the fuel difference and service fee may be charged to the Renter.
11. Mileage Usage
Whether a daily mileage limit will apply to the rented vehicle shall be determined between the parties.

If a mileage limit applies, the excess mileage fee shall be charged to the Renter if the specified limit is exceeded.
12. Accident, Damage and Breakdown
In the event of an accident, damage, breakdown, theft or similar situation during the rental period, the Renter must immediately contact Best Motor.
In case of an accident, the Renter must:

Move the vehicle to a safe location,

Notify the authorised authorities,
-
Have the necessary accident report or official report prepared,
-
Obtain the alcohol report, traffic report and required documents,
-
Not move or repair the vehicle without informing the Rental Provider.
All responsibility arising from actions taken without notifying the authorised authorities, without preparing an official report or without informing Best Motor belongs to the Renter.
13. Damage and Cost Responsibility
The Renter is responsible for returning the vehicle in the same condition as received.
All damages and costs arising from user error, careless use, use contrary to traffic rules, driving under the influence of alcohol, unauthorised driver use, use in prohibited areas or intentional damage belong to the Renter.
Damage to the vehicle body, glass, tyres, rims, interior upholstery, mechanical parts, electronic parts, keys, registration documents, equipment or accessories may be charged to the Renter.
14. Traffic Fines and Legal Responsibilities
All traffic fines, speeding violations, incorrect parking fines, parking fees, bridge/highway/toll violations and other legal obligations incurred during the rental period belong to the Renter.
Penalties received by the Rental Provider after the rental period may also be charged to the Renter according to the relevant usage date.
The Renter accepts that all legal, criminal and financial responsibility belongs to them during the entire period in which they use the vehicle.
15. Insurance and Vehicle Coverage
The insurance and coverage status of the rented vehicle may vary depending on the vehicle class and rental conditions.
In cases excluded from insurance or vehicle coverage, including user error, driving under the influence of alcohol, driving without a licence, unauthorised driver use, accidents without an official report, use in prohibited areas, intentional damage and use contrary to the agreement, all costs may belong to the Renter.
The Renter accepts that insurance or vehicle coverage provisions shall only be valid in cases of legal and agreement-compliant use.
16. Use of the Vehicle by Third Parties
The Renter may not allow another person to use, transfer, rent or commercially use the vehicle without the approval of the Rental Provider.
If the vehicle is used by a third party, all damage, penalties, accidents, losses and legal responsibilities arising from such use belong to the Renter.
17. Return Conditions
The Renter is responsible for returning the vehicle on the return date, time and location stated in this agreement.
The vehicle must be returned:

In accordance with the condition in which it was received,

Undamaged,
-
Complete,
-
Clean,
-
With the specified fuel level,
-
Together with the delivered equipment.
Additional fees may be charged in cases of late return, missing fuel, damage, lost equipment, excessively dirty return or use contrary to the agreement.
18. Cancellation and Change Conditions
The Renter may request a change or cancellation of the reservation date. Change requests are evaluated according to vehicle availability.
Cancellation and refund conditions may vary during high season, special days, public holidays or prepaid reservations.
If a deposit or advance payment has been received, refund conditions shall be applied according to the terms communicated during the reservation.
19. Force Majeure
Natural disasters, fire, flood, earthquake, war, epidemic, road closures, decisions of official authorities, severe weather conditions or situations beyond the control of the parties shall be considered force majeure.
In cases of force majeure, the obligations of the parties shall be re-evaluated according to the nature of the event.
20. Protection of Personal Data
The personal data of the Renter may be processed for the purposes of creating the reservation, providing the rental service, carrying out payment transactions, fulfilling legal obligations and ensuring communication between the parties.
The Renter accepts that the information provided within the rental process may be processed for the purpose of carrying out the service.
Best Motor protects customer information in accordance with privacy principles and does not share it with third parties in violation of the relevant legislation.
21. Resolution of Disputes
In disputes that may arise from this agreement, the parties shall first seek an amicable solution in good faith.
If the dispute cannot be resolved, the provisions of the applicable legislation shall apply and the authorised authorities shall have jurisdiction.

22. General Provisions
The Renter declares that they have read, understood and accepted all articles contained in this agreement.
This agreement enters into force on the date it is signed by the parties. For matters not included in this agreement, the applicable legislation and additional written agreements between the parties shall apply.
